Spirit Airlines granted petition to review US FAA decision on Newark slots

US Court of Appeals for DC granted a petition by Spirit Airlines to review and vacate a US FAA decision to retire peak period flight slots at New York Newark Liberty International Airport (Paxex.Aero, 21-May-2021). The Court stated: "We conclude the FAA's decision was final because it prevented Spirit from operating as many peak period flights as it would otherwise have done in the summer 2020 scheduling season". It also concluded the decision as "arbitrary and capricious because the agency disregarded warnings about the effect of its decision on competition at Newark". The slots were previously held by Southwest Airlines.
